Purpose and Reason:

Pursuant to 42 U.S.C. §415(i), the federal government is required to make annual COLA adjustments to SSI benefits.  We must reflect those updates in our regulations.  The following items are being updated in the regulation: Monthly Federal Benefit Rate (FBR), Optional State Supplement Payment (SSP) Limits, Medically Needy Income Standard for Non-LTSS Elders and Adults with Disabilities & Refugee Medical Assistance, Student Earned Income Exclusion, Maximum Monthly Maintenance of Need Allowance, Minimum/Maximum Community Spouse Resource Standards, Minimum Home Equity Limit, and Medically Needy Standards by Family Size.


The updated dollar amounts in this regulation directly impact Medicaid benefits and eligibility and are effective as of 1/1/2023. 


Brief statement of Reason for Finding Imminent Peril:

We are promulgating this as an Emergency amendment as these amendments need to be in place by 1/1/23, directly affect benefits and eligibility, and we did not receive all the necessary information from the federal government until 11/18/22.
