Purpose and Reason :

On March 6, 2018, the federal Centers for Medicare and Medicaid Services (CMS) issued an Informational Bulletin that contained the 2018 Dual Eligible Standards chart that displays the new standards for the Medicare Savings Program categories. This rule was amended and filed so that EOHHS could adopt the 2018 Standards as soon as possible. This rule was filed as an “emergency” rule on March 19, 2018 with the Rhode Island Secretary of State and took effect upon filing. This filing makes this regulation permanent.

Editorial Notes :

The agency requested an extension to the effective dates allowed by R.I. Gen. Laws § 42-35-2.10 for this emergency adoption which was promulgated on March 24, 2020. The extension was granted in accordance with Executive Order 20-72 which permits extensions for sixty (60) days. As a result of this additional extension, the effective dates have been revised and the regulation will now become ineffective on November 19, 2020.
