Regulation Authority :
Chapters 40-6 and 40-8 of the Rhode Island General Laws, as amended; Title XIX of the Social Security Act
Purpose and Reason :
These rules have incorporated and consolidated the Medicaid Code of Administrative Rules (MCAR), Sections 1303 and 1306, into one rule, “Medicaid Application and Renewal Processes.” The rule has been revised to be in conformity with current federal and state statutes and regulations; and to comply with the re-codification requirements of the Rhode Island Secretary of State.
Editorial Notes :
The agency requested extensions to the effective dates allowed by R.I. Gen. Laws § 42-35-2.10 for this emergency amendment which was promulgated on March 24, 2020. The extensions were granted in accordance with Executive Orders 20-72, 20-89, 20-111, and 21-16 which permit extensions for sixty (60) days. The effective dates have been revised and the regulation will now become ineffective on May 18, 2021.
