Chapters 40-6 and 40-8 of the Rhode Island General Laws
as amended; Title XIX of the Social Security Act

Purpose and Reason:

The State is federally required to accept applications from qualified hospitals that wish to make presumptive eligibility determinations pursuant to 42 C.F.R. 435.1110.  However, there are currently no hospitals that have requested to make these eligibility determinations.  EOHHS is amending regulation to clarify the Hospital Presumptive Eligibility status quo and process.
