Title 210 Executive Office of Health and Human Services
Chapter 30 Medicaid for Children, Families, and Affordable Care Act (ACA) Adults
Subchapter 00 Affordable Coverage Groups
Part 1 Medicaid Affordable Care Coverage Groups Overview and Eligibility Pathways (210-RICR-30-00-1)
Type of Filing Amendment
Regulation Status Active
Effective 08/17/2025

Regulation Authority:

Chapters 40-6 and 40-8 of the Rhode Island General Laws
as amended; Title XIX of the Social Security Act

Purpose and Reason:

EOHHS is revising regulation to include the corrected Parent/Caretaker income threshold.  The agency incorrectly implemented a threshold of 136% FPL (141% with the 5% disregard) for which the agency does not have authority.

Additionally, EOHHS is revising language related to the Transitional Medicaid (TMA) provisions.  Regulation currently states that the State employs two six month TMA periods.  However, the State has implemented the option to provide one twelve month period.  Regulation is being amended to reflect the State’s use of the twelve month TMA option.

Technical revisions are also included in this amendment.
