Purpose and Reason:

The Department of Human Services is promulgating the following amendments for Emergency rulemaking in order to comply with the provisions set forth in the One Big Beautiful Bill Act of 2025 (OBBB) (Pub. Law 119-21) for November 1, 2025, and to implement the SNAP COLA for FY 2026.

Implementation for November 1 per OBB addresses the following: Citizenship; Treatment of 3rd party Emergency Assistance Payments under State Law - in the reg. under Certain Vendor Payments; Standard Utility Allowance; Verifications; and ABAWDS;

COLA changes to be implemented include: Increase to maximum benefit allotment for a family of 4; Increase to the minimum benefit allotment to $24; Increase to the standard deduction amounts; Increase to the Standard Utility Allowance (SUA); Increases to the gross and net eligibility standards; Increase to the maximum shelter deduction; Increase to the homeless shelter deduction; and Increase to the standard telephone allowance. 


Brief statement of Reason for Finding Imminent Peril:

Failure to implement changes for COLA as well as those based on the H.R. 1 will result in the violation of the federal mandate and the risk of fines and/or loss of federal funding.
