Regulation Authority :

R.I. Gen. Laws § 5-65-1, et seq.

Purpose and Reason :

This proposed regulation amends the current regulation and creates a sole regulation that details the general administrative requirements for the registration and licensure of all contractors within the regulatory oversight of the Board. This regulation pertains to those contractors required to be registered/licensed pursuant  the Contractors’ Registration and Licensing Board Law, R.I. Gen. Laws Chapter 5-65; the Home Inspector Licensing Law, R.I. Gen. Laws Chapter 5-65.1; the Well-Drilling, Pump Installers, and Water-Filtration Contractors Licensing Law, R.I. Gen. Laws Chapter 5-65.2; the Underground Utility Contractors’ Licensing Law, R.I. Gen. Laws Chapter 5-65.3; and the Commercial Roofing Licensing Law, R.I. Gen. Laws Chapter 5-73. By creating a regulation that establishes a general set of rules, adherence and consistency across the disciplines will improve. As such, the regulation will promote public safety, health, and welfare by providing a mechanism to ensure that all persons conducting business in the regulated disciplines within the State of Rhode Island have the requisite skills, training, and experience necessary to safely and adequately conduct those activities within the state.  Any person who fails to become licensed as a home inspector or associate home inspector, as stipulated, is subject to penalties for operating without a license. 

The proposed regulation supplements the statutory requirements by:

·         Defining terms pertinent to the regulation;

·         Detailing and expounding on the

o   General administrative requirements

o   Registration/Licensing requirements

o   Application process

o   Educational Requirements;

·         Describing in detail the CRLB Complaint process, including

o   Notice of accepted complaints and initial CRLB investigation

o   Prehearing conferences and alternative dispute resolution

o   Violations

o   Appeals

o   Criminal Prosecution;

·         Describing the process by which the CRLB shall conduct administrative hearings, including

o   Expungements

o   Default

o   Disqualification/Incapacity of Hearing Officer

o   Miscellaneous provisions

o   Hearings – Public Information

o   Publication of Orders and Notices; and

·         Providing notice for Equal Access to Justice for Small Business.
