Purpose and Reason:
This rule is being removed from the Department of Human Services and filed under the Executive Office of Health and Human Services (EOHHS) as RIGL 42-7.2-2(b) provides EOHHS as the authority of the single State agency designated to administer and supervise the administration of the Medicaid Program under Title XIX of the Social Security Act. A technical change has been made to remove Section 0398.40, PersonalChoice Program, from Section 0398, Specific Waiver Programs of the Medicaid Rule. This section was promulgated and filed separately under EOHHS, as The Medicaid Personal Choice Program Rule, ERLID 6965, with an effective date of August 1, 2012.
