Purpose and Reason:
The Executive Office of Health & Human Services (EOHHS) is filing this “emergency” amendment to rule #0392 “Post-Eligibility Treatment of Income” in order to incorporate recent changes to the federal 2014 Medicaid “Spousal Impoverishment Standards”, the updated minimum monthly maintenance needs allowance (MMMNA), and the monthly housing allowances for community spouses that become effective July 1, 2014.
Brief statement of Reason for Finding Imminent Peril:
Because the revised standards were published by the federal Centers for Medicare and Medicaid Services (CMS) on June 10, 2014 and must take effect on July 1, 2014, EOHHS is filing as an “emergency.”
