RIGL 40-8; Title XIX of the Social Security Act; Federal Deficit Reduction Act of 2005

Purpose and Reason:

Effective 2/8/2006, in conformance with the federal Deficit Reduction Act of 2005, changes to Long Term Care Assistance are: the look back period is changed from 36 months to 60 months; the penalty period start time for the transfer of assets is the transfer date or the date that the individual would have been otherwise eligible for Medicaid, whichever is later and allows for partial month penalty periods; Undue hardship policy includes futher specifics.
