Rules and Regulations for Home Inspectors and Associate Home Inspectors

440-RICR-10-00-5 PROPOSED RULE

Title 440 Contractors' Registration & Licensing Board
Chapter 10 General Administration, Registration, Licensing, and Filing Claims
Subchapter 00 N/A
Part 5 Rules and Regulations for Home Inspectors and Associate Home Inspectors
Type of Filing Amendment
Regulation Status Proposed
Filing Notice Date 12/02/2025
Public Comment Dates 12/02/2025 to 01/02/2026

Regulation Authority:

R.I. Gen. Laws § R.I. Gen. Laws §§ 5-65-17 and 5-65.1-3

Purpose and Reason:

The Department of Business Regulation has proposed the amendment of this regulation to conform to clarifying statutory changes made to R.I. Gen. Laws § 5-6-2 of the electrician licensing law, 2024 Public Laws, ch. 209 & 210, effective 1/30/2025. http://webserver.rilegislature.gov/PublicLaws/law24/law24209.htm http://webserver.rilegislature.gov/PublicLaws/law24/law24210.htm

The Department is not exercising any discretion in making these amendments. The changes are only to ensure that this regulation is consistent with the updated electrician licensing laws and related guidance issued by Department of Labor and Training.

While preparing these amendments, it was discovered that cross references within § 5.24.5(D)(5) to §§ 5.22.5 and 5.22.6 (and which also appear throughout the regulation) were incorrect. Those subsections do not exist in the regulation. Upon further review, it was clear that those cross references are meant to point to the exclusions and prohibitions set forth in §§ 5.24.5 and 5.24.6 which contain the standards for the scope of the home inspection and general exclusions. All instances have been corrected. No change to status quo.
