Medicaid Managed Care Delivery Options (210-RICR-30-05-2)

210-RICR-30-05-2 PROPOSED RULE

Title 210 Executive Office of Health and Human Services
Chapter 30 Medicaid for Children, Families, and Affordable Care Act (ACA) Adults
Subchapter 05 Service Delivery Options
Part 2 Medicaid Managed Care Delivery Options (210-RICR-30-05-2)
Type of Filing Amendment
Regulation Status Proposed
Filing Notice Date 05/14/2025
Public Comment Dates 05/14/2025 to 06/13/2025

Regulation Authority:

R.I. Gen. Laws Chapters 40-6 and 40-8
as amended; Title XIX of the Social Security Act
115th Cong. (2018)

Purpose and Reason:

EOHHS is revising regulation to remove the incorrect Parent/Caretaker income threshold.  The agency incorrectly implemented a threshold of 136% FPL (141% with the 5% disregard) for which the agency does not have authority.

Additionally, EOHHS is removing language that describes the Medicaid Consumer Advisory Committee.  The work of this group will transition to the Beneficiary Advisory Council (BAC) which the State will be implementing as it is a required provision of the Ensuring Access to Medicaid Services Final Rule (Access Final Rule).

Technical revisions are also included in this amendment.

INACTIVE RULE Amendment - effective from 01/08/2018 to 07/29/2018
