Purpose and Reason:

RIDOH is proposing the following amendments:

  • § 24.3(B) – Updated incorporated reference to 2023 version of 21 C.F.R. 1010.3
  • § 24.3(C) – Changed date for incorporated reference of 21 C.F.R. 1020.3 to correct error in the existing regulations.
  • § 24.4(A)(3) – Added “or their designee” to the definition of “Director.”
  • § 24.4(A)(14) – Changed defined term from “Sanitization” to “Sanitize” to match the term used in the regulations.
  • § 24.7.1(E) – Reworded section to read “No pets or other animals shall be permitted in tanning rooms at any time except for service animals accompanying a qualified individual with a disability in accordance with R.I. Gen. Laws §§ 40-9.1-1, et seq. and 42-87-1, et seq. and/or the Americans with Disabilities Act, 42 U.S.C. 12101, et seq.”
