Subchapter | XX | Old Regulations Which Were Not Assigned Chapter-Subchap-Part |
Part | 1059 | Federal Consistency Manual |
Type of Filing | Repeal |
Regulation Status | Inactive |
Effective | 06/01/2015 |
Regulation Authority:
RIGL 46-23 et seq.
Purpose and Reason:
Repeal of CRMC Federal Consistency Manual. The manual describes the procedures and listed federal activities subject to federal consistency review pursuant to federal law specified in the Coastal Zone Management Act (CZMA) § 307(c)(3)(A) (16 U.S.C. § 1456(c)(3)(A)) and the federal implementing regulations at 15 C.F.R. Part 930. The manual was inadvertently listed several years ago as a state regulation. However, it is not a state regulation, rather it is a stand-alone federal document and should not be listed as a state regulation. Notwithstanding this fact, state implementation of the federal consistency requirements is administered though Section 400 of the Coastal Resources Management Program.
