Purpose and Reason:
The Regulation must be implemented immediately in order to provide much-needed funding for municipalities to proceed with capital improvements to their roads, bridges and appurtenances in accordance with the Municipal Road and Bridge Revolving Fund Act of 2013 (the Act). The Act establishes a municipal road and bridge revolving fund administered by the Rhode Island Clean Water Finance Agency (RICWFA) with project evaluation assistance from the Rhode Island Department of Transportation (RIDOT). The Act requires rules and regulations to be filed by September 1, 2013 and affords municipalities an opportunity to submit projects for funding from September 15th to October 15th.
Brief statement of Reason for Finding Imminent Peril:
The Regulation must be implemented immediately in order to provide much-needed funding for municipalities to proceed with capital improvements to their roads, bridges and appurtenances in accordance with the Municipal Road and Bridge Revolving Fund Act of 2013 (the Act). The Act establishes a municipal road and bridge revolving fund administered by the Rhode Island Clean Water Finance Agency (RICWFA) with project evaluation assistance from the Rhode Island Department of Transportation (RIDOT). The Act requires rules and regulations to be filed by September 1, 2013 and affords municipalities an opportunity to submit projects for funding from September 15th to October 15th. In view of Rhode Island’s crumbling infrastructure and the current financial constraints for maintenance and improvement of its roads and bridges, Rhode Island communities may forfeit millions of dollars for safety and mobility improvements to its infrastructure if these emergency rules and regulations are not promulgated. Further, any delay in the processing and evaluation of eligible projects will harm the economic welfare of the State and its citizens, especially those local businesses that depend upon construction work for financial viability.
