Purpose and Reason:
The Project Priority List was an Appendix of the Rules & Regulations for the Priority Determination System for Federal and State Assistance to Local Governmental Units for Construction of Water Pollution Abatement Projects (the “PriDet regulations”). The Department has now determined that the Project Priority List is a guidance document, therefore eliminating the requirement for the Department to amend the PriDet regulations annually in order to publish a new Project Priority List. Thus, consistent with the Governor’s mandate to repeal unnecessary regulations, the Department proposes the repeal of the subject regulations. Public notice of this repeal was previously posted in November of 2017, but a copy of the regulation to be repealed was inadvertently omitted from the notice. As a result, this public notice was reposted a second time with a copy of the repealed regulation attached. In addition, the second Public Notice for this regulation contained a typographical error in which the close of the comment period was listed at January 15, 2017, rather than January 15, 2018. The comment period was, in fact, left open until January 15, 2018. No comments were received during the public commenting period.
