Purpose and Reason:

The rule governs the treatment of nonpublic personal health information by all insurance licensees. The amendments are designed to incorporate the provisions of the Regulation into 230-RICR-20-60-7 to be consistent with the NAIC Model Regulation. The proposed amendments have a positive impact on small businesses as they are designed to combine all privacy notices into one regulation and repeal the separate regulation for health information. The Department repeals this regulation in order to incorporate the provisions of former Insurance Regulations 99 and 100 into 230-RICR-20-60-7 to restore the regulation to the NAIC Model and to amend the regulation to incorporate the most recent changes to the NAIC Model. There are no differences between the text of the proposed rule as published in accordance with R.I. Gen. Laws § 42-35-3 and the rule as adopted. Date signed by agency head: April 20, 2018.
