Purpose and Reason:

The rules relating to the Global Waiver have been expanded to include a more detailed description of the determination of level of care for beneficiaries who were residing in an institution on or before June 30, 2009 and who later transition to home and community based services. Additional “special circumstances” have been incorporated in the rule for grandfathered individuals who no longer meet the highest need. Personal Care Assistance Services is now an available service for those in the preventive level of care. Respite Services and Physical Therapy Evaluation and Services have been removed as available services for the preventive level of care. An additional reference to the rules regarding resource and income eligibility requirements has been added.
