11.1 Authority and Purpose

11.1.1 COVID-19 Virus and the Rhode Island State of Emergency

A. Prior to the implementation of any new procedure under this regulation, the Director of the Department of Human Services shall seek federal waivers or approval, when required, from the Federal agencies that provide funding and oversight for the programs the Department of Human Services administers. The Director shall also consider any guidance by these Federal agencies, when available, when implementing new procedures.

B. In accordance with RI Executive Order 20-39, upon withdrawal of the R.I. State of Emergency, as it relates to COVID-19, these new procedures shall lapse after three business days from the date of withdrawal of the State of Emergency for Rhode Island.

11.2 Licensed Child Care Center Weekly Rates During COVID-19 Reopening

A. Licensed Child Care Centers that choose to reopen during COVID-19 will be reimbursed at an enhanced rate.

1. Licensed Child Care Centers that choose to reopen during COVID-19 and held a Star Rating less than five (5) prior to COVID-19 will be temporarily paid at the 5-Star rate.

2. Licensed Child Care Centers that choose to reopen during COVID-19 and held a 5-Star rating prior to COVID-19 will be temporarily paid at the ninetieth (90th) percentile rates.

3. The following table displays the temporary CCAP weekly reimbursement rates for Licensed Child Care Centers:

B. Time Authorized and Enrolled:

1. Full time: 30 hours or more per week

2. Three Quarter Time: 20-29 hours per week

3. Half time: 10-19 hours per week

4. Quarter Time: 0-9 hours per week

C. Child’s Age Category:

1. Infant/Toddler: one (1) week up to three (3) years of age

2. Preschool: three (3) years up to first (1st) grade entry (this includes all Kindergarten Children)

Purpose and Reason:

This propsed rule addresses temporary rate enhancements for Licensed Child Care Centers and Licensed Family Child Care Homes during the COVID-19 reopening.  

Licensed Child Care Centers that choose to reopen during COVID-19

  1. and held a Star Rating less than five (5) prior to COVID-19 will be temporarily paid at the 5-Star rate.
  2. and held a 5-Star rating prior to COVID-19 will be temporarily paid at the ninetieth (90th) percentile rates.

Licensed Family Child Care that choose to reopen during COVID-19 will be reimbursed at an enhanced rate.

  1. Providers that choose to reopen during COVID-19 will temporarily be paid at the Step 4, Star 5 rate for the Infant/Toddler Age category.
  2. Providers that choose to reopen during COVID-19 will temporarily be paid at the Step 4 rate for the Preschool and School Age category.

 

Editorial Notes:

The agency requested an extension to the effective dates allowed by R.I. Gen. Laws § 42-35-2.10 for this emergency adoption which was originally promulgated as an emergency adoption on June 11, 2020. The extension was granted in accordance with Executive Order 21-37 which permits extensions for sixty (60) days. As a result of this additional extension, the effective dates have been revised and the regulation will now become ineffective on August 5, 2021.

Brief statement of Reason for Finding Imminent Peril:

DHS is providing temporary rate enhancements for Licensed Child Care Centers and Licensed Family Child Care Homes who choose to reopen during COVID-19. These rate enhancements will assist providers with increased expenses caused by stricter guidelines due to COVID-19, and allow for safe childcare for working families.
