Purpose and Reason:
In accordance with the Administrative Procedures Act, R.I. Gen. Laws Section 42-35-3(a)(1), the following is a concise statement regarding this rulemaking for the Rules and Regulations Pertaining to Smoke-Free Public Places and Workplaces (R23-20.10-SMOKE). The RIDOH is repealing this rule as it is duplicative of language already included in the Public Health and Workplace Safety Act (R.I. Gen. Laws 23-20.10), and RIDOH has the ability to operate wholly off of this statute and further regulations are not necessary for enforcement. In its determination to repeal this rule, RIDOH gave consideration to: 1) alternative approaches; 2) overlap or duplication with other statutory and regulatory provisions; and 3) significant economic impact on small business. Based on the duplication of existing statutory provisions, it was determined that repeal of the rule was the most appropriate course of action and would incur no additional costs.
