Regulation Authority:

RIGL 21-23

Purpose and Reason:

In accordance with the Administrative Procedures Act, Section 42-35-3(a)(1) of the RIGL, the following is a concise statement regarding the repeal of the Rules and Regulations for Non-Alcoholic Beverages, Drinks and Juices [R21-23-BB]. The RIDOH is repealing the Rules and Regulations for Bottled Water [R21-23-BB], the Rules and Regulations Prescribing Minimum Standards for Processing, Storage and Transportation of Fish and Fishery Products [R21.27; 21-31; 23-1-FFP], the Rules and Regulations Pertaining to Frozen Food Products [R23-1-FF], the Regulations Pertaining to Sanitary Standards for Manufacturing, Processing, Storage and Transportation of Ice [R23-1-ICE], the Rules and Regulations Prescribing Uniform Retail Meat Identity Standards [R21-33-PBP], the Grade A Pasteurized Milk Ordinance (2013 Revision), the Rules and Regulations for Non-Alcoholic Beverages, Drinks and Juices [R21-23-BB], and the Rules and Regulations Pertaining to Current Good Manufacturing Practice in Manufacturing, Packing or Holding Human Food [R21.27; 21-31; 23-1-GMP], and replacing them with rules and regulations for Good Manufacturing Practices for Food (216-RICR-50-10-4). This rulemaking consolidates the eight regulations to be repealed into one set of regulations, adopts several C.F.R. to align with RIDOH’s grants, and provides for national consistency. No comments were received during the public comment period, therefore no revisions were made to the proposed regulations and no justification for not implementing suggested revisions is required. In the development of this rule, consideration was given to: 1) alternative approaches; 2) overlap or duplication with other statutory and regulatory provisions; and 3) significant economic impact on small business. No alternative approach, duplication, or overlap was identified based on available information. RIDOH has determined that the benefits of this rule justify its costs.
