Purpose and Reason:
In accordance with the Administrative Procedures Act, Section 42-35-3(a)(1) of the RIGL, the following is a concise statement regarding the rulemaking for Lead Poisoning Prevention (216-RICR-50-15-3). This rulemaking adopts a new set of regulations and repeals the current lead poisoning prevention regulations in their entirety in order to better align with federal rules and standards, eliminate confusion, make changes to current fees and fee categories, and add a penalty matrix. In the determination for the repeal of this rule, consideration was given to: 1) alternative approaches; 2) overlap or duplication with other statutory and regulatory provisions; and 3) significant economic impacts on small business. No alternative approach, duplication, or overlap was identified based on available information. RIDOH has determined that this repeal will generate no additional costs.
