Purpose and Reason :
The Executive Office of Health and Human Services adopts 210-RICR-50-00-4 as a new regulation. It does not repeal or replace any existing Medicaid regulation. The regulation sets forth the following: LTSS Eligibility Factors; LTSS Planning and the Cost of Care; Process for Filing an Application; Forms Required as Part of the Application/Renewal Process; Application Assistance; Applicants’ Rights and Responsibilities; Eligibility Determination Timelines; Pre-eligibility Screening; EOHHS’ Responsibilities; Renewal Process.
Editorial Notes :
The agency requested an extension to the effective dates allowed by R.I. Gen. Laws § 42-35-2.10 for this emergency amendment which was promulgated on March 24, 2020. The extension was granted in accordance with Executive Order 20-111 which permits extensions for sixty (60) days. As a result of this additional extension, the effective dates have been revised and the regulation will now become ineffective on March 19, 2021.
