Purpose and Reason:

a.       Section 4.8.9(B):  Add section Eligibility so as to provide reader with eligibility criteria directly in the rule, which is currently lacking.  There is no effective change proposed or intended with this rule change.

b.      Section 4.8.9(G):  Add rule that tags shall be a permanent, single-use design, consistent with rules for lobster pot tags that has been in place since inception of those rules.  Rules for whelk pot tags should be consistent with rules for lobster pot tags to the greatest extent possible.

c.       Section 4.8.9(I):  Add rule that no person shall file a false claim of trap or trap tag loss, consistent with rules for lobster pot tags that has been in place since inception of those rules. Rules for whelk pot tags should be consistent with rules for lobster pot tags to the greatest extent possible.

d.      Section 4.8.9(L):  Amend to better describe types of tags and to align better with rules for lobster pot tags (in conjunction with proposed changes to lobster pot tag rules).  Rules for whelk pot tags should be consistent with rules for lobster pot tags to the greatest extent possible.

e.       Section 4.21:  Add new section to include contents of Part 11 “Education Certification for Commercial Shellfish Harvesters” in conjunction with repeal of Part 11.  Obsolete license types corrected. There is no effective change proposed or intended with this rule change.

f.        Section 4.19(D):  Amend rule regarding exemption of temperature control requirements for ocean quahogs and surf clams when said shellfish are destined for thermal processing.  This change is needed to maintain compliance with the FDA NSSP Model Ordinance. Such requirement does not apply to whelk per DOH and OWR.

g.      Other minor non-substantive clarifications. There is no effective change proposed or intended with this rule change.
