Purpose and Reason:
The purpose of this regulation is to adopt a strict limitations period for the filing of a Complaint with the Ethics Commission. As a result of comments received and considered, the Ethics Commission rejected Options B & C and voted to adopt Option A, which is a strict limitations period with no period of repose or discovery rule. Furthermore, as a result of comments received and considered, an originally proposed statutory period of ten (10) years was lowered to a period of six (6) years in the final adopted regulation.
