Purpose and Reason:
This regulation provides procedures to allow a respondent to stenographically record Commission proceedings relative to the complaint. Subsection (a) clarifies that the respondent may only transcribe proceedings at which he has a right of attendance or participation. He may not, for instance, transcribe the Initial Determination or the private deliberations of the Commission. Subsection (b) creates a condition precedent of requiring the respondent to file, at least seven (7) days prior to the proceeding, a written notice of intent to create a stenographic record. Subsection (c) clarifies that the respondent's permission to create a transcribed record may be withdrawn by the Commission if the required conditions are not met, if the stenographer is late, or if the recording causes or will cause delay or interference.
