Purpose and Reason:
This procedural regulation clarifies that, once properly in executive session, the Commission is permitted to exclude all other persons and parties in order to privately deliberate on the question or issue being raised. Subsection (b) expressly prohibits the Commission from allowing only one party access to its deliberations, or from having ex parte communications during private deliberations. Subsection (c) clarifies that the Commission's independent legal counsel is permitted to remain in the room for private deliberations to provide guidance on questions of law and procedure. Subsection (d) clarifies that the purpose of private deliberations is to allow unrestrained discussion, but that the Commission's official decision-making is a public matter.
