Purpose and Reason:
This amendment would update the language of the existing regulation to clarify current interpretations of the Code of Ethics and to align this provision with other recently adopted regulations, particularly Regulation 5004 on nepotism. The amendment clarifies that recusal is required whenever a public official's family member, household member, business associate or employer appears or presents evidence or arguments before his or her state or municipal agency. Although the proposed amendment contained two limited exceptions to the recusal requirements, these exceptions were not approved by the Ethics Commission and they do not appear in the final regulation as adopted.
