Purpose and Reason:

This regulation creates an exception to the Code of Ethics to allow for an appointed or elected member of a public agency to vote for him/herself to serve as an officer of that agency. For example, a member of a municipal zoning board could vote for herself to serve as the Chair, and a member of the House of Representatives could vote for himself to serve as Speaker. If the officer position carries with it any form of additional compensation, such compensation must have been previously established through a valid provision of law. If such compensation has not been previously established, then the public official must either waive the additional compensation or recuse from the vote. This exception recognizes the long-standing tradition of all members of public bodies participating in the election of officers.
