Rhode Island Swimming Pool and Spa Code

14.1 Authority
The Building Code Standards Committee, in accordance with the rule making authority of R.I. Gen. Laws § 23-27.3-109.1, has formally adopted and promulgated as the Rhode Island State Building Code, the provisions of the International Swimming Pool and Spa Code, as published by the International Code Council, Inc. (I.C.C.), together with amendments thereto hereinafter set forth to the articles and sections of this code.
14.2 Incorporated Materials
A. The provisions of R.I. Gen. Laws Chapter 23-27.3 establishing administration and enforcement are hereby incorporated by reference. Regulatory Administration Chapter 1 (§ 14.3 of this Part) immediately follows and is supplemental to the General Laws. Editorial Note: Code users please note:

2. Printed copies of the administrative and enforcement provisions of R.I. Gen. Laws Chapter 23-27.3 are available at the Office of the State Building Code Commission or on-line at http://www.rilin.state.ri.us/Statutes/TITLE23/23-27.3/INDEX.HTM.
3. The International Swimming Pool and Spa Code 2015 Edition is protected by the copyright that has been issued to the ICC. As a result, the State Building Code is not available in complete form to the public in an electronic format. The International Swimming Pool and Spa Code 2015 edition that is referred to within is contained in a printed volume and is also in an electronic format that have been published by the ICC under an exclusive license.
14.3 Chapter 1: Administration
The following Rhode Island amendments are made to the sections of Chapter 1:
Delete International Swimming Pool and Spa Code section 101.1 Title, and substitute the following:
101.1 Title.
These regulations shall be known as Rhode Island Swimming Pool and Spa Code SBC-14-2019, 510-RICR-00-00-14, hereafter referred to as "this code."
Add the following new section 101.1.1 referenced codes.
101.1.1 Referenced Codes.
The other codes referenced elsewhere in this code shall be considered part of the requirements of this code to the prescribed extent of each such reference.
1. Electrical.
The provisions of Rhode Island State Electrical Code SBC-5-2019, Part 5 of this Subchapter, shall apply wherever referenced in this code as the ICC Electrical Code, and shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings, and appurtenances thereto.
2. Mechanical.
The provisions of the Rhode Island State Mechanical Code SBC-4-2019, Part 4 of this Subchapter, shall apply wherever referenced in this code as the International Mechanical Code and shall apply to the installation, alterations, repairs and replacement of mechanical systems, including equipment, appliances, fixtures, fittings and/or appurtenances, including ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other energy-related systems.
3. Plumbing.
The provisions of Rhode Island State Plumbing Code SBC-3-2019, Part 3 of this Subchapter, shall apply wherever referenced in this code as the International Plumbing Code, and shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system.
4. Property Maintenance.
The provisions of the Rhode Island State Property Maintenance Code SBC-6-2019, Part 6 of this Subchapter, provides requirements for continued use and maintenance buildings and property, and of related plumbing, mechanical, electrical and fire protection systems in existing residential and non-residential structures.
5. Fire Prevention Code.
Wherever and whenever provisions of the International Fire Code 2015 editions are referenced, the appropriate Rhode Island Fire Safety Code (450-RICR-00-00-1 through 10) requirements shall apply.
6. Energy Code.
The provisions of the Rhode Island State Energy Conservation Code SBC-8-2019, Part 8 of this Subchapter, shall apply wherever referenced in this code as International Energy Conservation Code, and shall apply to all matters governing the design, alteration and construction of buildings and systems for energy efficiency.
7. Building Code.
The provisions of the Rhode Island State Building Code SBC-1-2019, Part 1 of this Subchapter, shall apply wherever referenced in this code as the International Building Code.
8. Residential Code.
The provisions of the Rhode Island One and Two-Family Dwelling Code SBC-2-2019, Part 2 of this Subchapter, shall apply wherever referenced in this code as the International Residential Code.
9. Existing Building Code.
The provisions of the Rhode Island State Building Code SBC-1-2019, Part 1 of this Subchapter, in conjunction with the State Rehabilitation Code SRC-1, Part 20 of this Subchapter, and the Rhode Island Fire Safety Code, 450-RICR-00-00-1 through 10 shall apply wherever referenced in this code as the International Existing Building Code.
Any and all such references to the various International Code Council family of codes shall be substituted for the appropriate state code as indicated above.
Delete International Swimming Pool and Spa Code sections 103 through 105 and 107 through 108.

Purpose and Reason:
RISBC-14 State Swimming Pool and Spa sets forth Rhode Island amendments to the International Swimming Pool and Spa Code (ISPSC), 2015 edition, and incorporates the ISPSC 2015 into the Rhode Island State Building Code.
Currently, various provisions relating to swimming pools are scattered throughout multiple Parts of the state building code in Title 510. Provisions in SBC-1 primarily related to public pools, including requirements in chapter 10 (occupancy limits for Assembly A-3 or A-4 uses) and chapter 31 (enclosure and safety for special construction). Provisions in SBC-2 provided the regulations for swimming pools, hot tubs, and spas, including criteria listed in Appendix G for an effective barrier surrounding the water area, as well as entrapment protection for suction outlets to reduce the potential for drowning of young children. The operational aspect of pool filtration and circulation systems were extensively changed to provide systems that would prevent such entrapment of children (small individuals) that had resulted in tragic deaths. The physical construction of pools is still regulated by similar Association of Pool & Spa Professionals standards that are now coauthored by ANSI APAP and ICC.
The proposed new SBC-14 has been separated and established as a Swimming Pool and Spas as singular code to reinforce its importance to a primary code, rather than an appendix in the residential document or scattered throughout the chapters of the building code. In addition to incorporating the construction and function standards, the energy operation standards of the SBC-8 Energy Code are also addressed within SBC-14.
The State Building Code Standards Committee has reviewed this new regulation and proposes it for adoption.
