Rules and Regulations for Provisional Voting

Help America Vote Act of 2002 (“HAVA”) (P.L. 107-252) and R.I.G.L. 17-7-5 et seq. and 17-19-24.1

Purpose and Reason:

This rule is proposed for amendment by the Board of Elections for the purpose of amending the procedure for the casting, certification and tabulation of provisional ballots pursuant to the requirements of the Help America Vote Act of 2002, hereinafter referred to as (“HAVA”) and to satisfy the requirements of voter identification at the polling places on election day in the state of Rhode Island. As a result of comments received, the following changes were made that were not originally part of the proposed text: In Section 2 the definition of "Election Official" was added. In Sections 5A, 6A, and 6B the phrase "Provisional Ballot Registration" was changed to "Provisional Ballot Voter Registration" to better describe the provisional ballot form. Also, in section 6A references to Section 4 of the Provisional Ballot Application were removed as that section no longer exists in the updated regulation.
