AUTHORITY: Title 20, Chapters 42-17.1, 42-17.6, and 42-17.7, and in accordance with Chapter 42-35-18(b)(5), Administrative Procedures Act of the Rhode Island General Laws of 1956, as amended.
Purpose and Reason:
REASON FOR RULEMAKING: 1. Proposal 1 - Commercial Menhaden regulations - change bycatch limit as defined in ASMFC Addendum I to Amendment 2: The amendment provides for consistency with a regional/federal Fisheries Management Plan (FMP). 2. Proposal 2 - Commercial Menhaden regulations - modify location of Fall opening for purse seining in the Menhaden Management Area (MMA): Request from industry to modify regulations to allow for harvest in areas within the MMA where harvest is currently prohibited. TESTIMONY AND COMMENTS (for not adopting a proposed rule): 1. Proposal 1: N/A (no changes made – all comments in support of proposal). 2. Proposal 2: The RI Marine Fisheries Council’s consideration of equally divided support and opposition to the proposed rulemaking resulted in their recommendation that the rule not be adopted as proposed. The Director elected to adopt this recommendation. CHANGES TO TEXT OF THE PROPOSED AND FINAL RULE: 1. Proposal 1: N/A (rule to be adopted as proposed) 2. Proposal 2: The proposed language will not be adopted; current language will be maintained. REGULATORY ANALYSIS: N/A
