AUTHORITY: Title 20, Chapters 42-17.1, 42-17.6, and 42-17.7, and in accordance with Chapter 42-35-18(b)(5), Administrative Procedures Act of the Rhode Island General Laws of 1956, as amended.
Purpose and Reason:
1. Annual review of management parameters for the commercial General Category Striped Bass fishery to maintain compliance with regional/federal Fisheries Management Plan (FMP) 2. Request from industry regarding management of the Floating Fish Trap Striped Bass fishery. TESTIMONY AND COMMENTS (for not adopting a proposed rule): 1. General Category: As a result of comments received from a workshop held specifically for the purpose of soliciting and vetting options for consideration, six options were ultimately chosen for consideration. Oral and written comments were received both in support and against all of the options. The final rule is based on the recommendation of the RI Marine Fisheries Council, which was based on oral and written comments received. 2. Floating Fish Traps: N/A (rule to be adopted as proposed) CHANGES TO TEXT (between proposed and final rule): 1. General Category: See Testimony and Comments above. The final regulation was selected as a result of public comment and as a logical outgrowth of the public vetting and APA process. The final rule was supported by public comment. Additional minor date changes were also incorporated into the final rule for consistency with other sections of the rule. 2. Floating Fish Traps: N/A REGULATORY ANALYSIS: N/A
