Chapters 42-17.1, 42-17.6, 20-1-2, 20-1-4, 20-3-2 through 20-3-6, 20-4 through 20-10, and in accordance with 42-35, of the Rhode Island General Laws of 1956, as amended.
Purpose and Reason:
The purpose of this filing is to adopt regulatory amendments in order to accomplish following: (1) to establish a Conimicut Point Shellfish Management Area; (2) to establish a soft-shell clam possession limit within the Conimicut Point Shellfish Management Area; and (3) to increase the minimum legal size for soft-shell clams from a diameter of 1-1/2 inches to 2 inches statewide. This filing also modifies Section 4.31, Tagging of Shellfish, in accordance with Part XVII – Maps, which was noticed on March 2, 2011 under a separate public notice. In addition technicial amendments were also incorporated in order to correct certain gramatical errors that were found in Sections 4.3, 4.5, 4.6, 4.7, 4.9, 4.12.1as well as updates to Sections 4.3.1, 4.3.2, 4.4(a) and 4.9 in order to substitute references to the Department of Environmental Management (which now possesses rule making authority) as opposed to the references to the Marine Fisheries Council that is currently provided in the four Sections to be modified.
