Purpose and Reason:

1. Provide for a May-December 2026 shellfish commercial other than shoredigging harvest schedule for the Providence River Shellfish Management Area (Area “E”)(section 4.7.2(W)(4)).

2. Amend the harvest closure time from sunset to 4:00pm for commercial shoredigging for the Providence River Shellfish Management Area (Area “E”)(section 4.7.2(W)(3)).

3. Other non-substantive changes:  section number changes and minor re-organization of sections (sections 4.7.2(W)(4) and 4.7.3(B)(3)).

This filing is exempt from the requirements from the requirements of §§ 42-35-2.7, 42-35-2.8, and 42-35-2.9.  No public hearing was held nor public comment period established pursuant to R.I. Gen. Laws § 42-17.1-2(38)
