Purpose and Reason:

This program will use NOAA funds to distribute gear to fishery participants to assist with meeting the new requirements of the Atlantic Large Whale Take Reduction Plan for the 2022 fishing year beginning May 1. DEM plans to distribute line and weak links to participants via an application process.


 

Brief statement of Reason for Finding Imminent Peril:

NOAA Fisheries published a final rule to modify the Atlantic Large Whale Take Reduction Plan, which is expected to reduce mortalities and serious injuries from fishing gear to North Atlantic right whales, humpback whales, and fin whales in September/October 2021. This rule mandates that all lobster pot/trap gear can only be fished with weak vertical lines. This regulation and subsequent spend plan is intended to mitigate the cost to the RI lobster pot/trap fishing industry. Implementation date for the final rule is May 1, 2022. The regulations governing the plan will allow the RIDEM Division of Marine Fisheries to attain the information needed to purchase weak line to distribute to the RI Lobster fleet.
 
The grant does not expire and any remaining funds will be held for the next phase of the take reduction plan scheduled for 2023.
 
This emergency regulation was initially promulgated in November of 2021.  However, the Department received fewer applications than expected during the application period.  The emergency regulation is being amended at this time to allow one additional application period with loosened eligibility critera, in hopes of encouraging more applicants to apply for the program.  The application period will be followed by DMF analysis and line distribution following manufacturing.
