Regulation Authority:

Chapters 42-17.1, "DEM", and 21-20, “Fruits and Vegetables Generally”; per the APA. Incorporates Federal Regulation Title 7, Part 205

Purpose and Reason:

To ensure the regulations were consistent with the adopted Federal Regulations; to increase fees charged by DEM to applicants for organic certification; to add the option of including on the DEM Organic Advisory Board an officer of the RI Northeast Organic Farming Association in place of the RI NOFA president; and to aid DEM in facilitating timely inspection of organic operations applying for certification by instituting an inspection deadline. Changes were made to the public draft in Rule 6(B)(1) based on public comment requesting that the definition of Northeast Organic Farming Assn. RI’s (NOFA RI) member on the DEM Organic Advisory Board (OAB) be changed by replacing "an officer" with "a member". DEM agreed and added "a member", which provides the option for the NOFA RI president to designate any member of NOFA RI as the OAB member.
