Purpose and Reason:
These rules replace two existing rules- the Division of Fish and Wildlife's Rules and Regulations Governing the Importation and Possession of Native Wildlife; and the Division of Agriculture's Rules and Regulations Governing the Importation and Possession of Exotic Wild Animals. With two different sets of rules, there is inherent confusion and inconsistency in application, standards, and enforcement. As a result of the hearing process, the following changes were made: The definition of the term "endangered species" was added. The term of record retention for the sellers of red eared slider turtles and exotic amphibians was reduced to three years. The permitting section was amended to clarify the prohibition of issuance of permits for private parties to own carnivores unless a rabies vaccine product is licensed for use in that species. A provision for the emergency movement of a permitted wild animal was included.
