Title 250 Rhode Island Department of Environmental Management
Chapter 150 Water Resources
Subchapter 10 Wastewater & Storm Water
Part 6 Rules Establishing Minimum Standards Relating to Location, Design, Construction and Maintenance of Onsite Wastewater Treatment Systems
Type of Filing Amendment
Regulation Status Inactive
Effective 06/27/2016 to 11/25/2018

Regulation Authority:

RIGL 42-17.1, 5-56, 5-56.1, 23-19.5, and 23-24.3, of the RIGLs of 1956, as amended; and R.I. Public Laws 09-198 and 09-199

Purpose and Reason:

The primary purpose of these amendments is to incorporate revisions made to the R.I. Cesspool Act of 2007 (R.I. Gen. Laws 23-19.15) by the R.I. General Assembly in the 2015 session. The Cesspool Act is incorporated into the OWTS Rules in the administrative findings, definitions, and in Rule 53. Under the proposed Rule 53, cesspools must be removed from service when the property served by the cesspool is sold or transferred. These amendments also make several clarifications and minor technical changes. One change was made pursuant to public comment: the final rule includes one change from the public notice draft, a change to Rule 17.4.1(B)(i) to increase the allowable footprint expansion from 400 square feet to 600 square feet.
