Regulation Authority:
Chapters 46-12, 42-35, 42-17.1 and 42-17.6
Purpose and Reason:
The amendments will bring statutory consistency to the rules, and seek to better protect public health and water quality by improving oversight of privately owned wastewater collection and pumping systems, as well as clarifying DEM’s general oversight of such systems. Both the existing and draft rules oversee wastewater treatment facilities with surface water discharges only; sub-surface disposal systems are not under the authority of these rules.
