Purpose and Reason:
The primary reason that DEM is revising these regulations is to modify Rule 22, the section governing supercedence. We have had concerns about the clarity of the language in the previous rules and potential arguments that have been raised by opposing counsel alleging that the language limits our ability to cite a UST facility for past non-compliance. No comments were received during the comment period.
