Purpose and Reason:
To encourage and simplify composting requirements for small and medium scale composting operations and facilities and encourage their development, as the Refuse Disposal Act was revised to include a ban on disposing food residuals for large generators (greater than 104 tons per year). The Food Waste Ban (RIGL Section 23-18.9-17) goes into effect 1/1/16. Pursuant to the hearing process, the Table in Rule 8.B.00 was revised to clarify the maximum quantity of material that Small-Scale Composting Operations and Medium-Scale Composting Facilities can accept, which includes unincorporated feedstock and feedstock that is staged, processed or in the curing stage. The only material that is exempt from the maximum quantity is finished compost. Rule 8.8.2 was changed to reflect the reduced frequency of sampling and testing for finished compost required by Small-Scale Composting Operations and Medium-Scale Composting Facilities.
