Purpose and Reason:

The purpose of this Regulation is to establish standards and procedures for the issuance of Licenses for Motor Vehicle Glass Repair and Replacement, and to generally assist the Department in carrying out the administration and enforcement of the terms and provisions of the Act so that the public interest may be effectively served. Summary of Post-Comment Changes: Below is a summary of the changes between the text of the proposed amendments contained in the notice of proposed rulemaking and the text of the final rule. These changes are all consistent with, and a logical outgrowth of, the amendments in the notice of proposed rulemaking in accordance with R.I. Gen. Laws § 42-35-6.1. In addition to this summary of changes, a redlined document showing the exact changes in the full regulatory document will also be produced. 1. Technician Certification – Section 3.8. In response to commentary received, DBR made the following changes: a. In Section 3.8(A), DBR added a cross reference to the definition of “technician” in Section 3.3(b)(17) to clarify that “technician” as used in this regulation is limited to a person that performs motor vehicle glass repair or replacement at the licensed shop. b. In Section 3.8(C), DBR edited the language due to an ambiguity pointed out by commentary and has clarified that technician certifications need to be updated every three (3) years, or as required by the course provider, to stay current with industry safety standards and changes in technology. 2. Safety Standards – Section 3.9 and relevant definitions in Section 3.3. In response to commentary received, DBR made the following changes: a. In Section 3.3(B)(18-22), relative to definitions of certain industry acronyms, DBR made minor edits after further review of the commentary received relative to safety standards. b. In Section 3.9, relative to the application of specific industry standards, DBR has changed the language to state more affirmatively that licensees shall implement safety standards that are consistent with the previously cited industry standards for motor vehicle glass repair and replacement. DBR also deleted some redundant information that was already set forth in the definitions (section 3.3) for the acronyms used in this section.
