Purpose and Reason:
The Department of Business Regulation ("Department") hereby adopts amendments to Insurance Regulation 25 effective March 11, 2008 and makes this statement in accordance with RI Gen. Laws § 42-35-2.3. The Department makes these amendments in order to incorporate the amendment to RI Gen. Laws § 27-9-5.1 made in 2006 that allows the Uniform safe driver point system to be reflected either as a flat dollar rate or a percentage rate. The proposed amendment also incorporates the prohibition of use of prior carrier type as a rating criteria (i.e. tiering and/or discounts/surcharges) as established in Bulletin 2005-10. There are two differences between the text of the proposed rule as published in accordance with RI Gen. Laws § 42-35-3 and the rule as adopted, other than editing changes. Those differences are: Section 3F-the Department has added the definition of renewal used in Insurance Regulation 25 to clarify that this definition is applicable in this Regulation as well. Section 7- the Department has removed the words "at each" and replaced them with "annual" to clarify the intent in accordance with the definition of "renewal."
