Purpose and Reason:
The purpose for the adoption of these regulations is to provide for the fair, prompt and orderly administration of investigations, prosecutions, adjudication and potential discipline of Notaries Public consistent with the Rhode Island Administrative Procedures Act (“APA”). The authority to discipline Notaries Public was delegated to the Department of Administration (“Department”) by the Office of the Governor through the issuance of Executive Order 09-08. There are no other regulations specifically governing investigations, prosecutions, adjudications and discipline of Notaries Public. Therefore, in order to effectively and transparently exercise its delegated authority, the Department is proceeding with the APA process for the adoption of the proposed regulations and welcomes public comment. No public comments were received and therefore no changes were made between the proposed and final regulations.
