RIGL 40-6-8
Purpose and Reason:
Effective October 1, 2012, the Department of Human Services Supplemental Nutrition Assistance Program (SNAP) will establish a $141 standard medical deduction from SNAP household income for households with an elderly or disabled member that incur medical expenses (excluding special diets) in excess of $35 a month. To be eligible for the standard medical deduction, households must verify that they incur more than $35 a month in qualifying medical expenses. Households with medical expenses over $176 a month may opt to document and claim all medical expenses. All eligible participating households will be converted to the standard medical deduction within two months of the effective start date. All eligible applicant households will have the $141 standard medical deduction applied at initial application. In addition, SNAP rules have been clarified to reflect that medicinal marijuana is not an allowable medical cost for purposes of determining SNAP eligibility and/or benefit level, and a technical revision has been made to clarify that state work study that is funded wholly or in part by Title IV of the Higher Education Act is excluded as income and some income exclusions apply to non-Title IV funds.
