Purpose and Reason:
Technical change to section 1002.40 (Residents of Institutions)to clarify that individuals who do not elect to receive the majority of their meals (over 50% of three meals daily) from a facility (such as Assisted Living) would not be considered residents of any an institution and would, therefore, be entitled to receive food stamp benefits if otherwise eligible.
