Purpose and Reason:
A Category II change request to the Rhode Island Global Choice Compact Waiver, with an effective date of October 1, 2011, is being submitted to Centers for Medicare and Medicaid Services (CMS) to eliminate the COLA for nursing homes for Rate Year 2011. OHHS is filing amendments to this rule under emergency rule making provisions to secure the current COLA. On October 1, 2011 the Direct Labor, Pass Through, and Other Operating cost centers, and Administrator’s Compensation as defined in the Principles of Reimbursement for Nursing Facilities dated October 1, 2011, will receive a 0.0% adjustment to the interim prospective rate for Rate Year 2011. Amendments to this rule are also being filed under regular rule-making provisions to eliminate the COLA for rate year 2011. This rule is being filed under the Executive Office of Health and Human Services as RIGL 42-7.2-2(b) provides EOHHS as the authority of the the single State agency designated to administer of supervise the administration of the Medicaid program under Title XIX of the Social Security Act.
