Purpose and Reason:

EOHHS amended this rule to clarify that for persons enrolled in Medicare Part B on or before December 31, 2015, the premium will remain at $104.90/month. For persons enrolling in Medicare Part B for the first time on and after January 1, 2016, the premium will be $121.80/month. These rules were originally filed as “emergency” rules and took effect on January 1, 2016. The State is adopting these amended rules to set forth these provisions in a timely manner in order to prevent wrongful denial, discontinuance, or interruption of benefits for Medicaid applicants and beneficiaries.
