Purpose and Reason:

The purpose of the amendments to MCAR #0372 sections 0372.05.05(A)(1)(B), 0372.05.10 (A)(1)(b), 0372.05.15 (A)(1)(c), 0372.05.35.05 (A)(1)(a)(b), and 0372.10(2) is to incorporate the new resource limits for individuals and couples who are beneficiaries of the Medicare Savings Program. The new resource limit for an individual is $7,280 and $10,930 for a couple, effective date of the rule. These new amounts are in accordance with federal guidance on this matter.

Brief statement of Reason for Finding Imminent Peril:

The State is adopting these amended rules on an “emergency” basis to set forth these provisions in a timely basis in order to prevent wrongful denial, discontinuance, or interruption of benefits for Medicaid applicants and beneficiaries.
